Divorces in South Carolina
- Different Than Other States

Unlike divorce law in other states South Carolina divorce law doesn't allow spouses to receive an instant no-fault divorce. One or both spouses in the marriage must establish a legally acceptable reason for a divorce to happen. Grounds for a divorce in Greer, SC include:

  • Desertion
  • Physical Cruelty
  • Habitual Drunkenness
  • Separation for One Year or More
  • Adultery
Divorce Attorney Greer, SC

If you or your spouse do not have the necessary grounds for divorce in Greer our family law firm can file a Separate Maintenance and Support action. This step lets the court order child custody alimony and marital bills until you can file for your divorce. During this period Cobb Hammett LLC gathers pertinent info on your spouse's character and assets that can strengthen your case should it be necessary.

Common Issues Associated
with Divorces in Greer

A divorce in Greer means more than the end of a marriage. It involves dividing the parties debts and assets determines child support and custody parameters and can establish alimony. At Cobb Hammett LLC many of our clients are able to reach agreements with their spouse to resolve these issues. Reaching an agreement lets both parties customize the terms of their divorce to conserve resources avoid trial and meet the family's needs.

Sometimes however two spouses cannot or will not come to terms with an agreement. In these situations a trial is possible and litigation is necessary. Our family law attorneys in Greer, SC. are highly experienced litigators and are well-equipped to handle any disputes revealed in the conference or courtroom.

Common divorce issues include:

 Law Firm Greer, SC
1.

Child Custody and Visitation

One of the most heart-wrenching difficult decisions for parents going through a divorce is resolving child custody and visitation issues. Child custody refers to how much time each parent will spend with their child and whether they can make decisions for them. According to South Carolina law child custody and visitation time are based on what is best for the child.

2.

Child Support

Like other U.S states a formula is used in South Carolina to determine how much child support a person must pay. This formula recommends the amount of child support based on factors like how much income the parents make the cost of childcare and the obligation to support children from other relationships.

3.

Alimony

In South Carolina there is no formula to determine how much alimony a person must pay. However courts consider several factors when deciding if alimony is needed how much alimony should be paid and how long a spouse must pay it. Those factors include each spouse's ability and need to pay alimony how long the marriage lasted and any marital misconduct that occurred. To make matters more confusing there are different alimony types including lump sum rehabilitative and reimbursement.

4.

Distribution of Property

In South Carolina marital property is the property that each spouse amasses from the date of the wedding to the time a spouse files for divorce. That property can often include marital debt. In a South Carolina divorce the courts will order an equitable division of property meaning fair under all circumstances but not necessarily equal.

Understanding Child Custody in Greer, SC.

As mentioned above decisions that involve child custody and visitation can be contentious for parents both emotionally and legally. As experienced empathetic divorce lawyers we understand how difficult this process can be. When we work with clients going through child custody battles we always make it a point to be with them through the ups and downs to help them stay centered. Whether you are the husband or wife in your divorce we share a common goal: finding an effective way to support your children and assure their wellbeing.

In South Carolina child custody is a loaded term. In the most general definition child custody determines when each parent is responsible for the physical care of the child and how much authority each parent has to make decisions in their child's life.

No two child custody cases are the same but a negotiated custody arrangement is usually preferred in the judge's eyes as each parent has input in the process. If the parents cannot come to an amicable resolution their fate is left in the hands of a Family Court Judge in South Carolina. The focus of child custody law is always on what is in the best interests of the child. What the judge determines to be the best interests changes depending on the judge.

There are different variations of custody in South Carolina (or custody arrangements) each with varying degrees of authority. When you consult with our family law attorneys at Cobb Hammett LLC we will go over the child custody process in detail and touch on each distinction to eliminate any confusion you have.

  • Help develop cooperative solutions to disputes or mediate when needed
  • Create an equitable parenting plan
  • Discuss the implications of the different forms of joint and sole custody
  • Problems related to child support
  • Modify court orders if you or your child's circumstances change
  • Enforcement of visitation and custody agreements
  • Much more

Understanding Child Support
in Greer, SC.

When children are involved in divorce cases child support is often ordered. Several factors can impact whether child support is ordered like the income-earning potential of the child's parents any custody arrangements that are created and what needs the child may have.

At Cobb Hammett LLC we have years of experience with child support issues relating to:

  • Cases where child support is needed for stay-at-home parents
  • Modifications and enforcement of child support mandates
  • Resolving support and custody disputes
  • Mediation arrangements to reach an agreement on child support. Compared to litigation going
  • the mediated route often means less stress and is more cost-effective than trial.

When you trust our family law firm in Greer for representation we can help calculate an estimate of how much child support you or your spouse may be ordered to pay. We can also perform a needs-based analysis in cases that involve large amounts of income. At the end of the day our goal is to make this frustrating process as stress-free as possible for you so that you can focus on living life and caring for your child.

Understanding Alimony in
Greer, SC.

Alimony (sometimes called spousal support or maintenance) is ordered by the court or negotiated between parties. This kind of spousal support has many factors like the income of both spouses how long they were married and the age of each spouse. Understanding Division of
Property in Greer, SC.

When there are no children marital property or issues of alimony divorces often proceed smoothly between amicable spouses. However most divorces in South Carolina are much more complex. Typically divorce involves a union between spouses that lasts for years and involves substantial marital property. This property can be personal property real estate family businesses debts out-of-state property debts bank accounts and more.

In these nuanced situations the applicable parties need assistance dividing their property. This help most often comes from seasoned family law attorneys like Cobb Hammett LLC.

When it comes to distribution of property certain types of properties that are controversial even under the property division rules in South Carolina. South Carolina is an equitable distribution state meaning that marital property is divided equitably but not always equally.

If you are going through a divorce it's important that you are aware of the following assets and the common issues their division presents:

Divorce Attorney Greer, SC
Pensions

Pensions:

Generally pensions are the second-largest asset in a marriage. When there are sufficient alternative income sources to compensate the non-pension holder South Carolina divorce courts may leave the pension rights with the spouse who earned it with future distribution available. Otherwise a divorce court may enter a Qualified Domestic Relations Order requiring the pension administrator to pay both the former spouse and worker.

Family Home

Family Home:

The family home or the primary residential property owned by the divorcing couple is usually considered a marriage's biggest asset. Dividing this kind of property can be complex and frustrating especially when there are kids involved.

Many divorcing couples have a hard time reaching an agreement on property division. Because the division of property depends on the complexity of you or your spouse's assets and liabilities it is crucial to consult with an experienced family law attorney to provide guidance.

South Carolina Ports (SC Ports) has announced the completion of a $55 million expansion project at Inland Port Greer, enhancing its intermodal capabilities and connectivity between the Port of Charleston and inland markets.

The upgrades include an expanded container yard, which will increase cargo capacity by 50 per cent, as well as an additional 9,000 feet of rail for handling longer trains.

New terminal operations and maintenance buildings have also been constructed, along with an expanded chassis lot.

These enhancements will allow Inland Port Greer to handle 300,000 rail lifts annually, meeting customer demand through 2040.

“This critical project not only supports the needs of our existing customers, but also positions the region to attract more cargo and new business,” said SC Ports President and CEO Barbara Melvin.

“South Carolina is among the states with the fastest-growing population and GDP in the nation, and SC Ports stands ready with ample capacity and infrastructure to meet the growing demand for reliable port service.”

The expansion comes in response to significant growth at Inland Port Greer, which has seen a 355 per cent increase in cargo volume from 2014 to 2024, averaging a 16 per cent annual growth rate.

“We have seen tremendous growth at Inland Port Greer since operations began, and this expansion and investment will allow us to continue providing excellent service as our customers grow,” Melvin added.

Part of the project was funded by a $25 million Better Utilizing Investments to Leverage Development (BUILD) grant from the United States Department of Transportation (USDOT), awarded in 2018.

SC Ports received $13.75 million from this grant, administered by the South Carolina Department of Transportation (SCDOT).

The project also received support from Norfolk Southern and BMW.

The expansion coincides with SC Ports’ plans to bring the Navy Base Intermodal Facility online in 2025, further strengthening the region’s rail access to major markets such as Atlanta, Memphis, and Louisville.

Strategically located along the I-85 corridor between Atlanta and Charlotte, Inland Port Greer serves as a key hub for goods destined for advanced manufacturers, mega retailers, and consumer goods industries across the Southeast.

The port’s operations contribute $44 billion annually to South Carolina’s Upstate economy, supporting approximately 132,000 jobs.

Are you in search for a unique local park with imaginative play spaces? We recommend Century Park’s Kids Planet in Greer. This park has multiple playgrounds with a castle, bridge, zip line and accessible playground.

The Benson Automotive Kid’s Planet playground is one of our favorite places to play. And kids LOVE this fun, thoughtful, and excellently designed playground.

IMPORTANT: The playground closes for maintenance every Wednesday from 7 am – Noon.

If you want to spend the day in Greer, enjoying the new playground and the other things this cute city has to offer; we can help with our Ultimate Visitors and Locals Guide to Greer, SC

What We Love About The Benson Automotive Kid’s Planet

Each of the playgrounds at Century Park’s Kid’s Planet have a perimeter fence and gates which help keep kids safe and within the play area. When you have kids like mine that both like to spontaneously run in opposite directions, this is helpful.

Differently-abled kids want to have fun, just like any other. There are special needs swings for those who need them. There’s even a special needs seat for the zipline… I love that children with special needs can also enjoy the coolest part of the playground! A tandem swing in the small children’s area allows a small child and adult to sit facing each other and swing.

Speaking of ziplines, other Upstate parks have just one, if any at all. That causes long lines and other issues when I’m sure you can imagine that this is one of the most popular spots on a playground! The playground at Kid’s Planet has two separate zipline structures that offer kids a total of four ziplines to enjoy! That means more fun for more kids!

It gets surprisingly hot in the Upstate, so kids (and the occasional adult) will be glad to have a misting area to run through. This isn’t a splash pad, so you don’t have to worry about bathing suits and towels. It’s just a fine mist of H2O to cool off sweaty kids while they have fun!

This is one of my favorite parts of the park! These hillside slides offer a fun and safe way to pick up speed while sliding down the hillside. The slide is embedded in the ground’s natural slope, so there’s nothing to fall off of! It’s as close to rollercoaster stomach-flipping fun as you are going to find in Greer, and it’s even fun to see grownups going down them.

Good news for those hot days – there is plenty of shade at Kid’s Planet playground! Between the picnic shelters and benches with shade umbrellas, you’ll be able to enjoy some cooler shade while still having a good view of your kid’s play area. There are also trees in the playground area with plenty of shade.

The castle isn’t hard to miss, but there are so many subtle features around the playground that tie together the fairytale theme! The rubber ground cover looks like a more, and there are cattails, mushrooms, frogs, and I’ve not confirmed this with Greer, but if you ask me, that trampoline looks like a little tar pit for anyone looking to harm the magical kingdom.

How many fairytale features can you find in the new Kid’s Planet Playground?

The music station was a popular feature from the old playground and one of the first my kids ran to at the new one. The area is large enough that your whole family can get in on the action and have an impromptu show for other guests at the playground!

At first glance, I thought this was a water feature on the playground. I was surprised to learn that it’s a trampoline! One day I might work up the courage to hop on and not care what I look like, bouncing up and down like Tigger!

This is one of the first things I look for when considering a park for my own personal preferences. When the bathrooms are clear across the park, and your children can’t time their needs to be synchronized, it’s a hassle to be running back and forth to the restroom. The facilities at Kid’s Planet are positioned right in the middle of the two playgrounds. This makes it so convenient!.

No pets are allowed on or inside the playground.

Bonus Things We Love About Century Park in Greer

The concession stand will is occupied by the popular Greer shaved ice purveyors, Sno Hut. They’ve been keeping kids and grownups cooled off since 1987.

We are excited to be part of this great park!

Amanda Grainger / Sno Hut

The picnic shelters make a perfect place to plan a party right next to the built-in entertainment of the playgrounds. You can reserve a shelter for your special event through the City of Greer. The rentals start at $20 for a two-hour slot.

If you are training for that 5k, or just trying to shed some lbs, the playground is a perfect spot to close the circles on your apple watch!

Top 5 Easter Egg Hunt Tips

What could go wrong at a fun event involving kids, candy, and the outdoors? I hope that I won’t shock any new parents out there, but the public egg hunt is not always all fun and games. It’s lots of fun but it can also result in tears from both kids and parents. Here are some of the top tips to help make the experience safe and enjoyable.

Different egg hunts have different rules and it’s smart to choose a hunt that fits your family’s age children and temperaments. For example, a fast, competitive child might thrive at a free-for-all egg hunt that’s every man for himself, but a shy child might find the same hunt frightening and leave without a single egg.

Find out . . . What are the rules for this egg hunt?

Beware of the hunts that allow parents to “help” kids. It’s not unheard of to watch fellow parents run toddlers over while they help their very capable preschooler fill an overflowing basket of eggs.

Easter is early-April this year which means the day could rapidly go from a cool early morning to a hot late morning or afternoon depending on the weather.

Make sure that you plan time to park. If your egg hunt has an age requirement for a specific time, your child will likely only be allowed to hunt at that time. If the hunt is large, plan at least 30 minutes for parking and registration before the hunt. Also pack snacks, water, extra clothes, and don’t forget the basket! You should always have a backup plan as well, just in case your kid’s basket ends up empty.

Be sure to go over your expectations of behavior before the craziness starts. Let your kids know that pushing, shoving, or taking other people’s eggs are a no-no.

In lieu (or in addition) to the big community hunt, consider planning your own private hunt with just your own kids or with your neighborhood or friends. Smaller hunts can allow for actual hiding (rather than just a bunch of eggs dumped in a field) and a smaller event can also be a fun chance to dye eggs and enjoy Easter games. It’s a simple event that the kids enjoy and it doesn’t involve tons of candy. With friends and family. Have fun!

South Carolina Ports (SC Ports) on March 26 announced the completion of a $55 million expansion project at Inland Port Greer, “strengthening the port’s statewide intermodal capabilities and connectivity from the Port of Charleston to inland markets.”

Upgrades include an expanded container yard to increase cargo capacity by 50%, 9,000 feet of additional rail to quickly handle longer trains, an expanded chassis lot, and new terminal operations and maintenance buildings.

With these enhancements, Inland Port Greer, which is located on Norfolk Southern’s (NS) Charlotte District, running between Greenville, S.C., and Linwood, N.C., on the Class I’s Coastal Division, can handle 300,000 rail lifts annually and meet projected customer demand through 2040, according to SC Ports.

“This critical project not only supports the needs of our existing customers but also positions the region to attract more cargo and new business,” said SC Ports President and CEO Barbara Melvin. “South Carolina is among the states with the fastest-growing population and GDP in the nation, and SC Ports stands ready with ample capacity and infrastructure to meet the growing demand for reliable port service.”

Customer demand drove the need for an expanded footprint, SC Ports noted. Inland Port Greer saw 355% cargo growth from 2014 to 2024, representing an average annual growth rate of 16%.

“We have seen tremendous growth at Inland Port Greer since operations began, and this expansion and investment will allow us to continue providing excellent service as our customers grow,” Melvin said.

The project was funded in part by a $25 million Better Utilizing Investments to Leverage Development (BUILD) grant awarded by the U.S. Department of Transportation (USDOT) in 2018. SC Ports received $13.75 million of the grant, which was administered by the South Carolina Department of Transportation (SCDOT).

SC Ports, SCDOT, Norfolk Southern, and BMW partnered together for the grant application.

The completion of the Inland Port Greer expansion comes as SC Ports prepares to bring the Navy Base Intermodal Facility (NBIF) online later in 2025, “enhancing South Carolina’s rail access to key markets like Atlanta, Memphis, Nashville, Louisville and beyond.”

Inland Port Greer’s strategic location along the I-85 corridor between Atlanta and Charlotte allows cargo to efficiently move between the Port of Charleston and inland population centers, with Norfolk Southern providing daily rail service.

“Inland Port Greer is an essential hub in our intermodal network, providing our customers—from advanced manufacturers to major retailers—with fast, reliable, and sustainable access between the Port of Charleston and inland markets,” said NS Vice President, Intermodal & Automotive Marketing Shawn Tureman. “This expansion enhances the infrastructure needed to meet rising demand while supporting more environmentally efficient freight movement. It also reflects the strength of our partnership with SC Ports. Together, we’re building a more connected, more resilient supply chain that drives economic growth across the Southeast.”

Inland Port Greer moves goods for advanced manufacturers, mega retailers, and consumer goods industries across the Southeast. Many of these companies have invested in Upstate operations to take advantage of the inland port, according to SC Ports, which generates a $44 billion economic impact in the Upstate each year, with port operations directly and indirectly supporting 132,000 jobs in the region.
