JAMES BARKLEY
Rachel Ferguson Bailey is an attorney and leader in the fields of probate, estate planning, appellate advocacy, and complex real property litigation. A native of Clover, South Carolina, Rachel earned her Bachelor of Arts in Political Science from the University of South Carolina. She went on to make history as a member of the founding class of the Charleston School of Law, where she graduated cum laude.

Prior to joining Cobb Hammett, Rachel served as Career Advisor for Charleston School of Law and taught upper-level courses focused on probate-related issues. Before entering academia, she maintained a private practice concentrating on appellate litigation, bankruptcy, contested foreclosures, estate planning, probate administration and litigation, and complex real property disputes.

Rachel brings extensive appellate and judicial experience to her practice. She spent more than a decade in Washington, D.C., working with the District of Columbia Court of Appeals, where she served as Special Counsel to Chief Judge Anna Blackburne-Rigsby and as a Staff Attorney. During her tenure with the court, Rachel worked on more than 2,500 appellate cases involving a broad range of legal issues, including administrative law, contracts, civil and criminal matters, employment discrimination, family law, the Home Rule Act, torts, workers’ compensation, and zoning. Earlier in her career, Rachel served as a Staff Attorney for the South Carolina Court of Appeals from 2007 to 2010.

In addition to her substantive legal work, Rachel served on numerous court committees dedicated to improving access to justice, enhancing court efficiency, strengthening communication among stakeholders, evaluating proposed rule changes, recommending bar admission procedures, and addressing court operations during the COVID-19 pandemic.

At Cobb Hammett, Rachel’s practice areas consist of Probate and Estate Planning as well as Appellate work. She also works closely with the firm’s Corporate Law Division, particularly in matters involving complex real property disputes.

Outside of work, Rachel enjoys spending time with her husband, Russ. She is an avid cook, a devoted fan of both the Atlanta Braves and Baltimore Orioles, and appreciates relaxing on Folly Beach whenever she can.
